Contributors Terms and Conditions
These terms and conditions form a legally binding agreement between you and Slippery Jacks, the supplier of the Service. Your statutory rights are not affected. Please note that Slippery Jacks sells greetings cards, A3 and A4 prints (in limited or unlimited editions), sculpture, jewellery, woodcraft and books. This list is not exclusive and other items can be added and removed as required.
Slippery Jacks also offers gallery selling space for displaying original work, at a small fee per item, but Slippery Jacks will take no part in additional sales negotiations for original pieces. Slippery Jacks sells via its website, its shop, shows, wholesale orders, and at discounted prices direct to the artist.
Acceptance of Artist
Slippery Jacks reserves the right to accept or decline your application to market Artworks through slipperyjacks.com. Your application includes your acceptance of these terms and conditions.
You warrant that all information supplied to Slippery Jacks is accurate, and up to date. You agree to have your artworks and descriptive information displayed on slipperyjacks.com. You will promptly inform Slippery Jacks of any changes in the information stored by Slippery Jacks including name, address and contact details, pricing of your Artworks, including Limited Edition Prints, and the Sold status of original Artworks.
Acceptance of Artworks
Slippery Jacks reserves the right to accept or decline your application to market any Artwork through Slippery Jacks. If accepted, you are offering your artwork to be used, for the sale of prints and cards, for a minimum period of six months. After six months you may remove your Artwork from Slippery Jacks if you choose. Otherwise Artwork, for prints and cards and well as originals in your gallery space, will remain on the website until either you request them to be withdrawn or we feel they should be removed.
In addition to selling your artwork through the website, Slippery Jacks may also sell your artworks via its shop and during shows. Cards and prints sold at the shop and at shows will be purchased from the artist at the wholesale rates specified in the attached schedule. Slippery Jacks will decide on which artworks are appropriate for sale via the shop and shows, and reserve the right to withdraw artworks from sale at the shop at any time.
Marketing Artworks through Other Channels
You may market your Artwork through other channels simultaneously with marketing through slipperyjacks.com but you may not use the Slippery Jacks brand on items produced. You must inform Slippery Jacks immediately if an original Artwork is sold through another channel so that we may record the fact on your Slippery Jacks gallery space.
You must supply at least one high-quality digital Image of each Artwork you wish to sell through Slippery Jacks. The Image must be in JPEG format and at a resolution of least 300dpi and a dimension of at least 600 pixels. The Gallery Image for original work, including sculpture, will show the entire artwork including frame (if framed). You may like to submit a number of images showing detail and aspect.
Delivery and Packaging
Slippery Jacks will accept responsibility for costs associated with the sale of cards and prints; these costs being passed on to the buyer. You are responsible and liable for costs of all materials, packaging and delivery costs for original Artworks. These costs cannot be reclaimed from Slippery Jacks and should be taken into account when pricing your Work.
You will ensure that Artworks are securely packaged and labelled for delivery to the Customer. Slippery Jacks will not accept claims for reimbursement in the event of damage to or loss of Artworks, and thus you should arrange the appropriate insurance when shipping. Please note that, for original work, you are responsible for arranging delivery with your customer.
Pricing and Artwork Particulars
Along with the Images of original Artwork you will supply the price at which the Artwork should be sold. Slippery Jacks will set the price for cards and prints based on supplier costs and sales figures. Slippery Jacks will notify you of your sales on a regular basis and notify you of commission applicable.
Please refer to the attached schedule detailing the costs of production and the monies owed to the artist for sales of greetings cards and unlimited prints. The schedule also details the commission percentage that Slippery Jacks will charge for selling original artworks, via the website, the shop and at any shows that your work may be displayed at. Slippery Jacks will update this schedule on a yearly basis to take account of changes in the cost of materials and the cost of production, but Slippery Jacks reserves the right to change these schedules at any time.
All cards and prints produced by Slippery Jacks for retail or wholesale will have the Slippery Jacks website address printed upon them.
Cards and prints sold at the shop and at shows will be purchased from the artist at the wholesale rates specified in the attached schedule. This is done to allow for the cost of operating the shop and the expenses involved in exhibiting at shows.
Payment for Artworks
Payment for cards and prints is made via PayPal unless an arrangement has been made by Slippery Jacks. Unless you set a price beforehand, you are responsible for negotiating payment for original work. Slippery Jacks can make available the PayPal payment method should you require it. In this case you must be aware that Paypal charge 3% and we would charge commission on the sale price. Payments to you will be made by cheque, Paypal transfer or bank transfer. Please refer to the attached schedule for details.
After Slippery Jacks has accepted your artwork, Slippery Jacks will create a space for you on the website and supply you with a sample pack of cards and prints based on your work.
Slippery Jacks will then sell via the website, its shop and shows and through wholesale orders, keeping detailed accounts. Regular payments will be made to you based on your sales. Due to the costs involved in processing payments by banks and other financial companies, Slippery Jacks will make payments of £15.00 and over. Amounts under this amount will be carried forward to the next month.
Slippery Jacks will sell cards and prints to you at discounted prices. If you require a large order for a show, you must give Slippery Jacks at least three weeks notice.
We can also offer additional services that include flyers and promotional posters, business cards and web solutions. Fees will vary on a per-job basis.
If, for some reason, cards and prints arrive at their destination damaged, Slippery Jacks will offer replacements. Original Artworks would be returned direct to you. When you ship original artworks to customers, it is important to arrange for the appropriate insurance.
You warrant that all work sold through the Site is free of any copyright restrictions or intellectual property disputes. You warrant the Work is yours to sell.
The copyright in the Artwork will remain with you even after ownership of the Artwork is transferred to the Customer.
Ownership of Customer relationship
You agree that the business relationship between the Customer and Slippery Jacks, to supply cards and prints in our house style, is entirely owned by Slippery Jacks. Outside this proviso it is in your best interests to cultivate a good relationship with customers who have purchased original works. Wholesale enquires should be passed directly to Slippery Jacks and we will only sell a design to ONE location per town. Individual artists have no rights to negotiate on behalf of Slippery Jacks.
You agree to defend, indemnify, and hold harmless Slippery Jacks, its officers, directors, employees, agents, and third parties, from your use of the service, including any violation of these rules.
Slippery Jacks provides this service on an "as-is" basis without warranty of any kind including the implied warranties of merchantability and fitness for a particular purpose.
This Agreement is entered into in England and shall be governed by, and shall be construed in accordance with, English law. The courts of England shall have jurisdiction to hear and determine any cost, action or proceedings, and to settle any disputes which may arise out of or in connection with these rules and you irrevocably submit to the jurisdiction of such courts.
Using the service constitutes acceptance of these rules.
